The rules of the road.

Legal documents are usually painful. We wrote ours differently. These are the terms that govern your use of Trakkr, explained like we would explain them to a friend.

Accepting these terms

TL;DR: By using Trakkr, you agree

When you create an account or start using Trakkr, you are entering into an agreement with us. This is that agreement. We have tried to make it readable, but it is still a legal contract.

Who can use Trakkr
You need to be at least 16 years old and capable of entering into a binding contract. If you are using Trakkr for a company, you confirm that you have the authority to bind that company to these terms. When we say "you," we mean both you personally and any organization you represent.
What you are agreeing to
By using Trakkr, you agree to these Terms of Service and our Privacy Policy. If you do not agree with something, please do not use the service. We would rather you walk away now than be unhappy later.
Keeping you informed
We may send you important emails about your account, service updates, or changes to these terms. These are not marketing emails, they are essential communications that help you use Trakkr effectively.

What Trakkr does

TL;DR: AI visibility tracking

Trakkr helps you understand how AI systems talk about your brand. Here is what we do and what we promise:

The core service
We query major AI platforms like ChatGPT, Claude, Gemini, and Perplexity using prompts relevant to your industry. We analyze the responses to see if and how your brand is mentioned. Then we give you reports, trends, and insights you can act on.
What we track
  • Brand mentions and sentiment across AI responses
  • How often AI systems recommend you vs competitors
  • The accuracy of information AI provides about you
  • Changes in visibility over time
  • Competitive positioning in AI recommendations
What we do not control
We cannot control what AI systems say about you. We can only show you what they are saying. The AI platforms make their own decisions about content, and those decisions can change without notice. We do our best to keep up, but we cannot guarantee coverage of every AI system.
Service evolution
Trakkr is constantly improving. We add new features, expand to new AI platforms, and refine our analysis. Occasionally we may retire features that are not working well. We will give you reasonable notice of any major changes that affect how you use the product.

Your account

TL;DR: Keep it secure

Your account is your gateway to Trakkr. Here is how to keep it safe and what we expect from you:

Account security
You are responsible for keeping your login credentials secure. Use a strong password. Enable two-factor authentication if available. Do not share your login with others or write your password on a sticky note. If you suspect someone has accessed your account without permission, tell us immediately.
One person, one account
Each person who uses Trakkr needs their own account. Do not share accounts between team members. If you need multiple users, upgrade to a team plan. Account sharing makes it impossible to maintain proper security and audit trails.
Accurate information
Keep your account information current. If your email changes, update it. If your company name changes, update it. We use this information to communicate with you and provide support. Wrong information leads to missed messages and frustration.
Your responsibility
You are responsible for everything that happens under your account. If your colleague logs in with your credentials and does something problematic, that is on you. This is why we emphasize separate accounts for separate people.

Payment & billing

TL;DR: Simple, transparent pricing

We believe in simple, transparent pricing. No hidden fees, no surprise charges, no gotchas. Here is how billing works:

How subscriptions work
When you subscribe, you choose a plan and billing cycle (monthly or annual). You authorize us to charge your payment method automatically on each billing date. Annual plans offer a discount but are billed upfront for the full year.
Automatic renewal
Subscriptions renew automatically. We will charge you at the start of each billing period unless you cancel before then. We send a reminder email before each renewal so you are never caught off guard.
Price changes
If we change our prices, we will give you at least 30 days notice. The new price takes effect at your next billing cycle. If you do not agree with the new price, you can cancel before it applies.
Our refund policy
New subscribers get a 14-day money-back guarantee. If Trakkr is not right for you, just let us know within 14 days and we will refund your payment in full, no questions asked. After that, refunds are at our discretion. We are reasonable people, so if you have a genuine issue, talk to us.
Failed payments
If a payment fails, we will retry a few times and email you. If we still cannot charge you after a reasonable period, we may suspend your access until payment is resolved. We do not want to do this, so please keep your payment information up to date.
Taxes
Prices do not include taxes. Depending on where you are, we may need to charge VAT, GST, or other applicable taxes. These will be shown clearly before you complete your purchase.

Your content

TL;DR: You own everything you create

Let us be crystal clear about something important: your content belongs to you. We have no interest in claiming ownership of your brand data, prompts, or insights.

You own your data
Everything you upload or create in Trakkr remains yours. Your brand information, the prompts you configure, the reports you generate, your competitor lists. All yours. We do not claim any ownership or intellectual property rights over your content.
License to operate
To run Trakkr, we need permission to store and process your content. By using the service, you grant us a license to do exactly that. This license is limited to operating the service for you. We will not use your brand data to help your competitors, sell it to third parties, or do anything else sketchy.
Aggregated insights
We may use anonymized, aggregated data to improve Trakkr and create industry benchmarks. For example, we might report that "brands in the SaaS category saw a 15% increase in AI visibility this quarter." This data never identifies you or your specific brand.
Your responsibilities
Make sure you have the right to use any content you upload. Do not upload content that infringes on someone else's intellectual property. If you are tracking competitors, you are responsible for ensuring that is appropriate for your situation.
Backup and export
You can export your data at any time from your account settings. We recommend doing this periodically. While we maintain robust backups, having your own copy is always smart.

Acceptable use

TL;DR: Be a good citizen

Trakkr works best when everyone plays fair. Here are the ground rules for being a good citizen of our platform:

Use it as intended
Trakkr is designed for monitoring AI visibility. Use it for that purpose. Do not try to use it as a general web scraper, an AI prompt injection tool, or anything else it was not designed for.
Do not break things
  • Do not attempt to access other users' accounts or data
  • Do not try to overload our systems or interfere with the service
  • Do not reverse engineer, decompile, or extract our source code
  • Do not use automated tools to abuse the platform
  • Do not circumvent rate limits or usage restrictions
No illegal activity
Do not use Trakkr for anything illegal. This includes tracking brands you have no legitimate interest in, gathering competitive intelligence through deceptive means, or any other activity that would make a lawyer nervous.
Reselling
Do not resell access to Trakkr without our written permission. If you are an agency or consultant who wants to offer Trakkr to clients, talk to us about our agency program.
Consequences
If you violate these rules, we may suspend or terminate your account. We do not take this lightly, but we will protect our platform and other users if necessary.

Service availability

TL;DR: We aim for 99.9% uptime

We work hard to keep Trakkr running smoothly. Here is what you can expect from us and what happens when things go wrong:

Our uptime goal
We aim for 99.9% uptime. That means Trakkr should be available almost all the time. We invest heavily in reliable infrastructure, redundancy, and monitoring to make this happen.
Planned maintenance
Sometimes we need to take things offline for maintenance or upgrades. We schedule this during low-traffic hours and give you advance notice when possible. These windows are brief and infrequent.
Unplanned outages
Despite our best efforts, things occasionally break. When they do, we work to fix them as quickly as possible. We post updates on our status page so you know what is happening and when to expect resolution.
Third-party dependencies
Trakkr relies on AI platforms like OpenAI, Anthropic, and Google. If one of these services has an outage, it may affect our ability to fetch fresh data. We cannot control their uptime, but we design our systems to be resilient.
Data freshness
AI visibility data is updated regularly, but it is not real-time. There may be a delay between when an AI platform changes what it says about your brand and when that change appears in Trakkr. This is normal and expected.

Liability & warranties

TL;DR: The legal fine print

This is where things get a bit more legal. We will be as clear as possible about what we promise and what we do not:

The service is provided as-is
We work hard to make Trakkr excellent, but we cannot guarantee perfection. The service is provided "as is" without warranties of any kind, either express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement.
What we are not responsible for
  • Business decisions you make based on Trakkr data
  • The accuracy of AI responses from third-party platforms
  • Temporary service interruptions or outages
  • Lost profits, data, or business opportunities
  • Any indirect, incidental, or consequential damages
Liability cap
Our total liability to you for any claims related to Trakkr is limited to the amount you paid us in the 12 months before the claim arose. This cap exists because unlimited liability would make it impossible for us to offer the service.
Your indemnification
If someone sues us because of something you did while using Trakkr, you agree to defend, indemnify, and hold us harmless. This is a standard provision that protects us from liability for your actions.
Exceptions
Some jurisdictions do not allow certain limitations on liability. If that applies to you, these limitations may not fully apply. Nothing in these terms limits liability for fraud, gross negligence, or anything else that cannot legally be limited.

Ending the relationship

TL;DR: No hard feelings

Relationships sometimes end. Here is how that works with Trakkr, whether you decide to leave or we need to part ways:

You can leave anytime
Cancel your subscription from your account settings whenever you want. No phone calls, no guilt trips, no retention specialists. Just click a button. Your access continues until the end of your current billing period, then your account becomes inactive.
We can terminate too
We may suspend or terminate your account if you violate these terms, fail to pay, or if we are legally required to do so. We try to give you notice when possible, but serious violations may result in immediate termination.
What happens to your data
After you cancel, you have 30 days to export your data. After that, we delete your account and associated data in accordance with our Privacy Policy. If you want us to delete everything sooner, just ask.
If we shut down
In the unlikely event that we need to shut down Trakkr entirely, we will give you as much notice as possible and help you export your data. We would also refund any unused portion of annual subscriptions.
Survival
Some parts of these terms survive termination, like limitations on liability and your obligation to pay outstanding fees. These continue to apply even after our relationship ends.

General provisions

TL;DR: The boring but necessary stuff

Here is the miscellaneous section where we cover everything else. It is less exciting, but still important:

Governing law
These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales. Before taking legal action, please contact us first so we can try to resolve the issue directly.
Changes to these terms
We may update these terms as our service evolves. When we make significant changes, we email you in advance and update the "last updated" date at the top. Continuing to use Trakkr after changes means you accept the new terms.
Entire agreement
These terms, along with our Privacy Policy, make up the entire agreement between you and Trakkr. Any previous agreements or understandings are superseded by this document.
Severability
If any part of these terms is found to be unenforceable, that part is removed and the rest remains in effect. We do not want one bad clause to invalidate the whole agreement.
No waiver
If we do not enforce a right under these terms, that does not mean we waive that right. We might just be being nice, or we might be busy. We can still enforce it later.
Assignment
You cannot transfer your account or these terms to someone else without our consent. We can transfer our rights and obligations if Trakkr is acquired by another company, but we will let you know if that happens.
